Overview
These Terms and Conditions (“Terms”) govern your use of the products, services, websites, applications, content, and other offerings (collectively “Services”) provided by ChargeTronix and its affiliates (collectively “ChargeTronix”).
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not use the Services.
ChargeTronix may modify these Terms at any time, and your continued use of the Services constitutes acceptance of the updated Terms. You are responsible for reviewing and becoming familiar with any modifications.
Services
ChargeTronix provides electric vehicle charging stations, related hardware and software products, network services, and other offerings to enable and manage EV charging.
ChargeTronix services may include:
- EV charging stations and related hardware
- Mobile applications to locate and operate ChargeTronix stations
- Software platforms to manage and analyze charging services
- Account registration and login credentials
- Customer support and service plans
Your Responsibilities
You agree to use ChargeTronix Services only for lawful purposes and in accordance with these Terms and applicable law. You are responsible for maintaining the confidentiality of your account login credentials.
You agree to pay all applicable fees charged by ChargeTronix for Services you purchase or use. Taxes and additional fees may apply. You consent to recurring charges from ChargeTronix for ongoing Services until cancellation.
You must comply with all safety instructions and proper usage guidelines when operating ChargeTronix stations. You are responsible for any property damage or injuries resulting from improper use.
ChargeTronix Rights
ChargeTronix reserves the right to modify, suspend or discontinue any Services with reasonable notice to customers when practicable. ChargeTronix may also terminate your account for any violation of these Terms.
ChargeTronix owns all intellectual property and proprietary rights in the Services, including any software, technology, content and materials. Customers receive limited license to use the Services for their internal purposes only.
Billing and Payment
You authorize ChargeTronix to charge your provided payment method for Services you purchase or use. Taxes, regulatory fees, and other charges may apply to your purchases.
If your payment fails, ChargeTronix may suspend your account and seek to collect any unpaid balance. You are responsible for keeping your payment information current. Please contact us immediately regarding any billing disputes.
Warranties and Liability
ChargeTronix provides Services on an “as-is” basis without warranties. ChargeTronix expressly disclaims any warranties of merchantability, fitness for particular purpose, non-infringement and any warranties arising from course of dealing.
In no event shall ChargeTronix be liable for indirect, incidental, special or consequential damages arising from use of the Services. ChargeTronix’s total liability shall not exceed the amount paid by you for the specific Service giving rise to the claim.
Dispute Resolution
ChargeTronix requires binding individual arbitration for any disputes. Class action lawsuits and class arbitration are prohibited. This provides a quick and cost-effective dispute resolution process.
Miscellaneous
You agree to keep ChargeTronix information confidential and not disclose it to third parties. You agree to defend, indemnify and hold harmless ChargeTronix in any lawsuit arising from your use of the Services.
These Terms are governed by California law. If any provision is deemed unenforceable, the remaining provisions will remain in effect.
